Content and Information

You grant FFA an irrevocable, non-exclusive, transferable, sub-licensable, royalty-free, worldwide licence to use all content, including photos and videos, that is covered by intellectual property rights that you post on or provide to the FFA Bid Site.

FFA may, at its absolute discretion, remove any content or information from the FFA Bid Site or prevent users from accessing any or all aspects of the FFA Bid Site.

By using the FFA Bid Site, you provide to FFA the following binding commitments:

1. You will not send or otherwise post unauthorised commercial communications to other FFA Bid Site users;
2. You will not collect users’ information, or otherwise access the FFA Bid Site, using automated means (such as harvesting bots, robots, spiders, or scrapers) without express written permission from FFA;
3. You will not upload viruses or other malicious code;
4. You will not solicit login information or access an account belonging to someone else;
5. You will not share your password, let anyone else access your account, or jeopardise the security of your account in any way;
6. You will not abuse, intimidate or harass any FFA Bid Site user;
7. You will not post content or take any action on the FFA Bid Site that infringes another’s rights or is illegal;
8. You will not post content that is threatening, pornographic or that contains nudity or graphic or gratuitous violence or content otherwise likely to be deemed inappropriate by FFA;
9. You will not use the FFA Bid Site, including providing information or content, in a manner that is unlawful, misleading, malicious, discriminatory; and
10. You will not facilitate or encourage any violations of these Terms and Conditions.

Termination

At its absolute discretion, FFA may terminate and prohibit your access to all or any parts of the FFA Bid Site.

You may terminate your membership of the FFA Bid Site at any time. Where you do so, you will continue to be bound by these Terms and Conditions as applicable.

Third party websites

The FFA Bid Site may contain links to third party websites. FFA is not responsible for the condition or the content of those websites, as they are not under FFA's control. Any link(s) provided are solely for your convenience. The presence of links does not amount, expressly or impliedly, to any endorsement of the website(s) or the products or services provided there. Your access to those websites and use of their products and services is entirely at your own risk.

The FFA Bid Site and its contents are provided without any representations or warranties of any kind, either express or implied. FFA disclaims all representations and warranties, including by way of example but not limitation, as to fitness for a particular purpose, to the fullest extent permitted by applicable laws. In addition, FFA does not represent or warrant that the information and/or facilities accessible via the FFA Bid Site are accurate, complete or current, or that the FFA Bid Site will be free of defects, including, but not limited to, viruses or other harmful elements. The user of the FFA Bid Site assumes all costs arising as a result of the use of the FFA Bid Site.

Limitation of Liability

To the fullest extent permitted by applicable laws, FFA or any of its respective directors, employees, affiliates or other representatives will not be liable for loss or damages arising out of or in connection with the use of, or inability to use, the materials in and/or facilities or services offered through the FFA Bid Site, including, but not limited to, indirect or consequential loss or damages, loss of data, income, profit or opportunity, loss of or damage to property and claims of third parties, even if FFA has been advised of the possibility of such loss or damages or such loss or damages were reasonably foreseeable. If this clause is not enforceable in whole or in part in any jurisdiction due to relevant laws, then in no event shall FFA's total liability to you for all damages, losses, and claims (whether in contract, tort (including, but not limited to, negligence), or otherwise) exceed the amount paid by you, if any, for accessing the FFA Bid Site.

Governing Law

FFA makes no representation that material in and/or facilities or services offered through the FFA Bid Site will be available for use in locations outside of Australia, or that they comply with any legal or regulatory requirements of such other locations. Those who choose to access the FFA Bid Site do so at their own risk and on their own initiative and are responsible for compliance with local laws, to the extent any local laws are applicable.

These terms shall be governed by and construed in accordance with the laws in force in New South Wales and the Commonwealth of Australia. Any dispute under these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia and, by using the FFA Bid Site, you hereby submit to the jurisdiction of such courts for such purposes and waive any and all objections to jurisdiction or venue in such courts.

Miscellaneous

Any waiver of any provision of these terms must be in writing and signed by FFA to be valid. A waiver of any provision hereunder shall not operate as a waiver of any other provision, or a continuing waiver of the same provision in the future. If any court of competent jurisdiction finds any provision of these terms to be void or unenforceable for any reason then such provision shall be ineffective to the extent of the court's finding without affecting the validity and enforceability of any remaining provisions. These Terms and Conditions represent the entire understanding and agreement between the parties relating to the subject matter herein and supersede any and all prior statements, understandings or agreements whether oral or written, and shall not be modified except in writing by FFA.
